用戶協議

 

為保障甲方使用乙方提供之線上遊戲(以下簡稱本遊戲)服務的相關權益,請於註冊登記使用本遊戲之服務前,詳細閱讀以下規定。另外,由於此處之條款隨時可能變更,為保障甲方的權益,敬請定期查閱!

 

第一條

甲方瞭解一旦甲方同意本協議,即推定甲方已經詳細審閱並瞭解本契約書的所有條款達三日以上,並願意完全遵守本契約書與本遊戲相關之遊戲管理規章、規則,受本契約條款內容之拘束。

 

第二條

一旦甲方同意本協議,即推定甲方同意、瞭解並願意遵守本契約書中的所有條款。

提醒甲方:遊戲服務之申請,若甲方為無行為能力人(如未滿七歲之未成年人),應由其法定代理人為之;若為限制行為能力人(滿七歲但未滿二十歲),應得法定代理人之同意。

 

第三條

為促進兒童及少年身心健全發展,並保障其相關權益,甲方瞭解本遊戲屬於「遊戲軟體分級管理辦法」分類標準下之「保護級」。一旦甲方按下「我同意」之按鍵,即表示甲方符合相關法令對使用本級別之服務的年齡要求。

 

第四條

為讓甲方體會本遊戲之本質與樂趣,並於瞭解自身消費需求後再為虛擬物件之購買,甲方同意乙方於其開始遊戲七日內暫不提供任何消費服務,包括但不限於購買任何虛擬物件、功能性道具或裝飾性道具等。

 

第五條、契約書適用之範圍

乙方提供甲方線上遊戲服務及其他相關服務(以下簡稱本服務),甲乙雙方關於本服務之權利義務,依本契約書條款之約定定之。

 

第六條、契約之內容

以下視為本契約之一部分,與本契約具有相同之效力:

一、乙方有關本服務之廣告或宣傳內容。

二、費率表及遊戲管理規則。

前項契約內容相互間有衝突者,應為消費者有利之解釋。

 

第七條、名詞定義

本契約之名詞定義如下:

一、線上遊戲:係指甲方透過網際網路連線經由乙方所架設之網路伺服器,使甲方得與其他不特定之多數人得同時連線進行遊戲之軟體。

二、遊戲網站:係指由乙方為提供本遊戲服務所建置之網站。

三、遊戲管理規則:係指由乙方訂立,專供為規範遊戲進行方式、會員行為守則等相關規則。

四、遊戲歷程:係指甲方進行本遊戲時,乙方電腦系統可得提供之電磁記錄。

五、儲值:係指甲方預付乙方之金額或其餘額。

六、外掛程式:係指非由乙方提供,以影響或改變乙方線上遊戲之運作、營運、進行方式為目的之程式。

七、開始遊戲:係指甲方申請乙方所提供之線上遊戲服務帳號時。

八、遊戲套件:係指具備主、副程式,且能完整執行線上遊戲所有功能之軟體。

九、下載相關軟體:係指由網路下載遊戲套件之行為。

十、必要成本:係指乙方為履行本契約而已支出之成本或已給付予第三人之費用。

 

第八條、服務範圍

本契約書所提供之服務,係由乙方提供網路伺服器,供甲方透過網際網路連線登入進行本遊戲。但此不包括甲方向網際網路接取服務業者申請接取網際網路之服務,及提供上網所需之各項硬體設備。

 

第九條、遊戲登錄

甲方申請使用本遊戲,應於遊戲網站登錄與身分証明檔相符之個人資料。甲方所登錄之個人資料,有錯誤或已變更時,應立即更正之。

如甲方未提供正確之個人資料或原提供之資料已不符合真實而未更新,乙方得於甲方提供真實資料或更新資料前,暫停本服務(包含但不限於暫停甲方遊戲進行及遊戲歷程查詢之服務)。但甲方能以個人資料以外之方式證明其為契約當事人者,不在此限。

甲方得於開始遊戲後七日內,以電子郵件或書面告知乙方解除本契約,甲方無需說明理由及負擔任何費用。解除契約後,甲方得就未使用之儲值向乙方請求退費。

甲方就前項契約之解除,需負回復原狀之義務。包括但不限於刪除甲方之遊戲角色、帳號、虛擬物件等。

 

第十條、計費標準

費率調整時,乙方應於預定調整生效日三十日前於遊戲網站、遊戲進行中及遊戲登入頁面公告;若甲方於註冊帳號時已登錄電子郵件者,並以電子郵件通知甲方。

費率如有調整時,應自調整生效日起按新費率計收;若新費率高於舊費率時,甲方在新費率生效日前已於遊戲網站中登錄之儲值應依舊費率計收。

乙方依本條地址所為之通知發出後,以書面通知到達甲方,或電子郵件進入甲方之電子郵件伺服器中,推定已送達。

 

第十一條、本遊戲應載明之資訊

乙方應於遊戲網站及遊戲套件包裝上載明以下事項:

一、依電腦軟體分級辦法規定標示遊戲分級級別及禁止或適合使用之年齡層。

二、進行本遊戲之最低軟硬體需求。

三、第十二條第一項所列之退費權利。

四、有提供安全裝置者,其免費或付費資訊。

乙方目前提供之安全裝置為數位安全卡 ( 免月費 ) OTP( 免月費 ) 、聰明鎖 ( 免月費 ) 、手機鎖 ( 免費 )

 

第十二條、遊戲套件與軟體之退費

甲方得於購買本遊戲套件或付費下載相關軟體後七日內,向原購買處之業者,請求全額退費。

前項情形,原購買處之業者不處理或無法處理者,由乙方依甲方之請求立即退費。

第十三條、契約之生效

甲方於契約審閱期過後初次註冊帳號,進入顯示本契約條款之網頁,並按「同意」之選項後,視為甲方同意本契約條款之規定。

本契約若任何一部無效,不影響其他部份之效力。

 

第十四條、帳號與密碼之使用

乙方於甲方完成註冊程式後,應核發一組帳號及密碼;該組帳號一經設定即不得變更,且僅供甲方使用。甲方不得將該組帳號、密碼轉讓或出借予第三人使用,如因而產生糾紛,由甲方自行負責。

前項之密碼得依乙方提供之修改機制進行變更。乙方人員 ( 含客服人員、遊戲管理員 ) 絕不會主動詢問甲方之密碼。甲方就本條之帳號及密碼的保管負全責,如因保管不周致帳號、密碼遭他人非法使用,此屬可歸責於甲方之情形,亦由甲方自行負責。

 

第十五條、帳號與密碼之非法使用通知與處理

任一方發現第三人非法使用甲方之帳號,或有使用安全遭異常破壞之情形時,應立即通知對方。乙方接獲甲方通知,或乙方通知甲方後,經甲方確認有前述情事,乙方得暫停該組帳號或密碼之使用權限,並更換新帳號或密碼予甲方。

前項情形,乙方應返還甲方已扣除之儲值,或補償相當之遊戲費用,但可歸責於甲方者,不在此限。

 

第十六條、電磁紀錄被不當移轉時之處理方式

甲方如發現帳號、密碼被非法使用,且遊戲電磁紀錄遭不當移轉時,應立即通知乙方查證,經乙方查證甲方之個人身分無誤後,應立即暫時凍結該組帳號,並暫時限制相關線上遊戲使用人就本服務之使用權利。

乙方如知悉前項電磁記錄移轉之歷程或持有該電磁紀錄第三人之身分資料,乙方應於暫時限制遊戲使用權利之時起,即刻以書面或電子郵件通知持有前項電磁紀錄之第三人提出說明。如該第三人未於接獲通知時起七日內提出說明,乙方應直接回復遭不當移轉之電磁紀錄予甲方,不能回復時可採其他雙方同意之相當補償方式,並於回復後解除對相關線上遊戲使用人之限制;惟乙方有提供免費安全裝置(如防盜卡、電話鎖等)而甲方使用者,乙方得直接回復遭不當移轉之電磁紀錄予甲方。

持有第一項電磁紀錄之第三人不同意乙方前項之處理,乙方得依報案程式,循司法途徑處理。

乙方依第一項規定限制甲方之使用權時,在限制使用期間內,乙方不得向甲方收取費用。

甲方如有申告不實之情形致生乙方或其他線上遊戲使用人權利受損時,應負一切法律責任。

 

第十七條、遊戲歷程之保存與查詢

乙方應保存甲方之個人遊戲歷程紀錄,且保存期間為二個月,以供甲方查詢。如逾電磁紀錄保存期限二個月者,恕乙方無法受理甲方之查詢申請。

甲方得以書面、網路,或親自至乙方之服務中心申請調閱甲方之個人遊戲歷程,且須提出與身份証明文件相符之個人資料以供查驗,查詢費用為新台幣 50 元/帳號,由甲方自行負擔。

乙方接獲甲方之查詢申請,應提供第一項所列之甲方個人遊戲歷程,並於七日內以光碟或磁片等儲存媒介或以書面、電子郵件方式提供資料。

 

第十八條、個人資料

關於個人資料之保護,依相關法令規定處理。

除依法律規定或相關主管機關要求外,未經甲方同意時,乙方不得任意出售、交換、出租或公開甲方的姓名、地址、電子郵件信箱,以及其他依法受保護之個人資訊。

於法令許可範圍內,乙方於履行契約目的範圍內,得使用甲方之個人資訊以提供甲方其他服務,包括但不限於接收乙方之會員電子報。

甲方同意乙方得就甲方之個人資料作成會員統計資料。如該統計資料不涉及揭露甲方之個人身份,甲方同意並允許乙方為任何合法公開之使用。

於下列情形發生時,乙方得依法公開甲方之個人資訊或遊戲歷程:

一、因應法令及相關主管機關之要求。

二、為保障乙方之財產及權益。

三、在緊急情況下為保障乙方會員或公眾人身安全時。

四、與第三人相關之遊戲歷程,經該第三人向乙方調閱者。

 

第十九條、電磁記錄

本遊戲之所有電磁紀錄均屬乙方所有,乙方並應維持甲方相關電磁紀錄之完整。

甲方對於前項電磁記錄有支配之權利。

 

第二十條、資訊公開

乙方應於遊戲網站上提供本遊戲相關資訊,並定期更新。

 

第二十一條、連線品質

乙方各項系統設備因預先計畫所需之系統維護停機,應於七日前於遊戲網站中公告,且於甲方登入時通知,並於遊戲進行中發佈停機訊息。

乙方應確保其系統設備,無發生錯誤、畫面暫停、遲滯、中斷或不能進行連線的情形。如因而致不能提供甲方服務時,乙方應返還甲方已扣除之儲值,或免收相當之遊戲費用,或遞延甲方得進行遊戲之時間。

 

第二十二條、系統安全

乙方應依本契約之規定負有於提供本服務時,維護其自身電腦系統,符合當時科技或專業水準可合理期待之安全性。

電腦系統或電磁記錄受到破壞,或電腦系統運作異常時,乙方應於採取合理之措施後儘速予以回復。

乙方違反前二項規定,致生甲方損害時,應依甲方之受損害情形,負損害賠償責任,但乙方能證明其無過失者,得減輕其賠償責任。

乙方電腦系統發生第二項所稱情況時,於完成修復並正常運作之前,乙方不得向甲方收取費用。

若乙方伺服器超載致有電磁記錄無法寫入或相類似情況發生時,若係因可歸責於乙方之原因所致者,乙方得重開伺服器,將遊戲回復至未超載前之狀態,另甲方同意乙方得額外擬定合理方案逕行補償;若係非可歸責於乙方之原因所致者,乙方得重開伺服器,將遊戲回復至未超載前之狀態。

甲方同意購買之產品或服務(包括但不限於虛擬道具)可能因系統、程式設定或其他因素而無法依原設定使用,若因此造成使用權益受損,可歸責於甲方之事由者,甲方同意乙方將無法賠償或補償此部分之損害或損失;倘係因可歸責於乙方所致者,甲方同意依乙方統一之補 償或賠償方式處理。乙方提供之所有產品或服務,包括但不限於虛擬裝備、電磁記錄等,皆屬乙方或相關權利主體所有;甲方瞭解並同意依遊戲使用之設定,以正常、一般之使用方式使用至該等虛擬裝備自然消滅或遊戲服務終止時。期限屆滿或條件成就時,甲方同意乙方對此等產品或服務,包括但不限於虛擬裝備,將無法提供任何後續處理,包括但不限於延續商品或服務之使用期限、補償、賠償或提供其他類似之產品或服務等。

 

第二十三條、程式漏洞

因遊戲程式漏洞致甲方受損時,乙方應依甲方之受損害情形,負損害賠償責任。但乙方證明其無過失者,得減輕其賠償責任。

 

第二十四條、遊戲管理

為規範遊戲進行之方式,乙方應訂立合理公平之遊戲管理規則,甲方應遵守乙方公告之遊戲管理規則、中華民國相關法規及一切國際網際網路之規定與慣例,並對其透過本服務傳輸之一切內容負法律責任。

甲方同意並保證不得於本遊戲、規定無效:

一、抵觸本契約之規定。

官方 gamecenter 粉絲團及其他可供公眾觀覽之地方公佈、散佈、傳送任何毀謗、不實、威脅、不雅、猥褻、不法、或侵害遊戲公司、遊戲代理商及他人相關權益、權利、智慧財產權之言論或資訊。

遊戲管理規則之變更應依第二十七條之程式為之。

遊戲管理規則有下列情形之一者,其

二、剝奪或限制甲方之契約上權利。

但乙方依第二十五條之規定處理者,不在此限。

為進一步管理並維護乙方提供之遊戲品質,甲方同意乙方得於甲方以利用外掛程式、病毒程式、遊戲程式漏洞或其他違反公平合理之方式進行遊戲時,同意乙方給甲方的郵箱推送郵件 , 由系統自動將該違反本契約或遊戲管理規則之紀錄留存,前述紀錄包括 CPU 類型、作業系統類型、作業系統版本、電腦名稱、電腦 ID 、不當程式存取路徑等資料。

 

第二十五條、違反遊戲管理規則之處理

除本契約另有規定外,有事實足證甲方於本遊戲中違反遊戲管理規則時,乙方應於遊戲網站或遊戲進行中公告,並以線上即時通訊方式或電子郵件通知甲方。經乙方通知改善而未改善或改善後再次違反者,乙方得依遊戲管理規則,按其情節輕重限制甲方之遊戲使用權利。

乙方依遊戲管理規則停止甲方進行遊戲之權利,每次不得超過七日。如經警告後再犯者,乙方得逕行終止契約。

除構成契約終止事由外,乙方依遊戲管理規則對甲方所為之處置,不得影響甲方依本契約應享之權利。

 

第二十六條、申訴權利

甲方不滿意乙方提供之連線品質、遊戲管理、費用計費、其他相關之服務品質,或對乙方依遊戲管理規則之處置不服時,得於收到通知之翌日起七日內至乙方之服務中心或以電子郵件或書面提出申訴,乙方應於接獲申訴後,於十五日內回覆處理結果。

乙方應於遊戲網站或遊戲管理規則中明訂二十四小時服務專線與電子郵件位址。

 

第二十七條、契約之變更

乙方修改本契約時,應於遊戲網站首頁或遊戲之登入頁面公告之。若經甲方按「同意」後繼續進行遊戲者,視為甲方同意修改。甲方若為反對之表示者,視為甲方對乙方終止本契約之通知。

甲方應確保留存於乙方之地址或電子郵件之正確,若有變更,甲方應立即通知乙方。乙方依本條地址所為之通知發出後,以書面通知到達甲方,或電子郵件進入甲方之電子郵件伺服器中,推定已送達。

第二十八條、契約之終止及退費

在出現下列情況時,甲方可以通知乙方終止本契約:

1 乙方伺服器問題導致遊戲無法運行超過 48 小時。

2 、乙方接到甲方申訴三十日內未予回復。

契約終止時,乙方就甲方未使用之儲值於扣除必要成本 30% 後,應於三十日內以現金、信用卡、匯票或掛號寄發支票方式退還甲方未使用之儲值或遊戲費用。

甲方有下列情事之一者,乙方以書面或電子郵件或公告之方式通知甲方後,得立即終止本契約之一部或全部:

一、利用任何系統或工具對乙方電腦系統之惡意攻擊或破壞。

二、以利用外掛程式、病毒程式、遊戲程式漏洞、違反本協議書第 24 條、張貼買賣遊戲帳號之言論或以其他違反公平合理之方式進行遊戲。

三、經司法機關查獲從事任何不法之行為。

乙方對前項事實認定產生錯誤或無法舉證時,乙方應對甲方因終止契約所生之損害負賠償責任。

 

第二十九條、送達

有關本契約所有事項之通知,甲方同意乙方得以甲方登錄之連絡地址或電子郵件地址為送達。

乙方依本條地址所為之通知發出後,以書面通知到達甲方,或電子郵件進入甲方之電子郵件伺服器中,推定已送達。

倘因甲方未提供正確之個人資料或原提供之資料已不符合真實而因未更新致乙方無法為送達者,乙方對甲方因無法送達所致之損害不負任何賠償責任。

 

第三十條、準據法

本契約以中華民國法律為準據法。

 

第三十一條、管轄法院

因本契約涉及的一切爭訟,雙方合意以臺灣臺北地方法院為第一審管轄法院。但不得排除消費者保護法第四十七條或民事訴訟法第四百三十六條之九規定小額訴訟管轄法院之適用。

- 您的產品資訊,例如移動應用的名稱、內容、類別和某些特性;推廣管道資訊等。

- 瞭解和管理帳戶;

- 回應您的客戶服務要求;

- 瞭解您的企業和產品需求以確定適用的產品和服務;

3 、使用 TalkingData 服務詳述

 

1 TalkingData 分析服務

 

TalkingData 為移動應用提供資料統計分析服務,通過您在應用中集成了 TalkingData 資料 SDK API 後,您的應用將通過技術手段收集和傳送您終端使用者的相關資料,通過我們的服務來分析這些資料以瞭解您的應用在不同終端設備上、使用平臺或應用分發管道的表現和使用者使用的情況。

 

您終端使用者的資料通常包括但不限於: SDK API 版本、平臺、時間戳記、應用識別字、應用程式版本、應用分發管道、 iOS 供應商識別字( IDFV) iOS 廣告識別字( IDFA) 、安卓廣告主識別字、設備型號、終端製造廠商、終端設備作業系統版本、會話啟動 / 停止時間、語言所在地、移動網路 / 國家代碼、時區和網路狀態( WiFi ) 、硬碟、 CPU 和電池使用情況等。

 

根據您移動應用的類型和和您對統計分析選項的要求,您終端使用者的資料還有可能包括:使用者性別、年齡、地理位置、使用者觸發特定事件、錯誤報告和頁面流覽量等等。

 

為實現分析服務之目的, TalkingData 分析服務將通過您的應用將上述資料發送到 TalkingData 的伺服器上,由 TalkingData 以聚合性資料和分析報表的形式展現,您可以通過登陸在我們網站中的帳戶查閱相關統計和分析結果。

 

2 )行業報告服務

 

我們將基於分析服務所收集的資料,以及通過其他合法管道獲得的資料建立 TalkingData 資料庫,作出應用在發行商、行業內、特定區域和市場方面的績效評估或行為模式分析報告(統稱“行業報告”)。行業報告將以不可識別的聚合形式表現,既包括由 TalkingData 自主發佈的,也包括根據您的需求定制形成的。

 

特別的情況下,我們也會根據 TalkingData 的統計模型做出某種或某類應用的評估結果,該評估結果可能會源於從您的應用中得到的資料因而與您的應用呈現出一定的吻合性,但這些評估結果是我們基於資料模型計算出來的,用於評估目的的,並且是聚合性和匿名的。

 

3 )移動端受眾資料管理平臺( TalkingData   DMP

 

我們將基於分析服務所收集的資料,以及通過其他合法管道獲得的資料建立 TalkingData 資料庫,通過彙聚、清洗、智慧運算,形成 TalkingData 使用者識別項( TDID ),構建龐大的協力廠商精准人群資料中心。該中心將共有共同特徵和興趣的移動終端使用者分類到不同的人群中,將以開放介面形式為全行業從業者提供人群標籤性資訊,説明優化投放和提升行銷效果。

 

用戶可以通過 TalkingData   DMP 匹配 TDID ,購買對應的標籤資訊。這些標籤資訊通過海量移動端受眾資料的彙聚、匿名化處理、智慧運算獲得,最終以統計分析資料的形式體現,不包含任何受眾的個人隱私性或可識別性資料。

 

4 )協力廠商商業合作

 

除用戶以 TalkingData   DMP 的形式使用外,我們也會與協力廠商合作以多種形式將 TalkingData   DMP 平臺中經過處理、加工後的資料用於商業化使用,這些合作包括但不限於:與廣告主、廣告聯盟或者其他廣告經營者的合作,將資料用於優化廣告投放和提升行銷效果。我們與協力廠商分享的資料不含有任何個人的隱私性或可識別性的內容。

 

5 )智慧資料市場服務( Smart   Data Market

我們為資料需求方建立智慧資料市場,實現 TalkingData 自行擁有或經合法權利人授權許可交易的資料及資料衍生產品(無論以資料形式,工具或應用軟體形式,統稱“資料產品”)的線上交易。

我們保證自行提供的資料產品權屬清晰,遵守相關法律法規有關個人資訊保護的規定。通常情況下,資料市場進行交易和授權許可使用的資料產品為去識別化的資料產品。在特定情況下如需獲取個人資訊資料時,   應獲得相關個人的明確的授權且僅限於在特定範圍內獲得使用權限。同時,我們盡最大努力和合理謹慎地要求協力廠商的資料權利人保障資料產品滿足上述要求。

 

6 )諮詢服務

4 、個人資訊收集和使用獲得授權的例外

8)                   為履行您所簽訂的合同所必需的;

二、最終使用者資料的授權與同意

 

您十分清楚,為了使用我們的資料統計和分析之目的,您需要我們收集、存儲、加工來自于您的應用程式的終端使用者的個人資訊。因此,您必須承諾:

 

1 )您已經獲得終端使用者充分必要的授權、同意和許可,允許使用我們履行服務所需的目的;

 

2 )您已經獲得終端使用者充分必要的授權、同意和許可,允許我們對已收集的資料進行匿名的、聚合性的處理和轉移(包括可能的國際間轉移);

 

3 )您已經遵守並將持續遵守適用的法律、法規和監管要求,包括但不限於制定和公佈有關個人資訊保護和隱私保護的相關政策;

 

4 )您已經向終端使用者進行披露和說明,允許我們對已收集的資料進行匿名的和聚合性的處理後,為互聯網定向廣告目的轉移給非關聯方使用,但您同時應向終端使用者提供易於操作的選擇機制,說明用戶如何以及何時可以行使選擇權,並說明行使選擇權後如何以及何時可以修改或撤回該選擇,使得用戶可以選擇同意或不同意為互聯網定向廣告目的而收集和使用其身份關聯資訊以及向協力廠商轉讓該資訊;

 

如因您違反上述承諾導致您的終端使用者對我們主張任何形式的索賠或權利要求,或導致我們被捲入到法律或行政程式,您將負責全面解決,並賠償我們因此可能遭受的任何形式的損失。

 

三、您如何管理您的個人資訊

 

我們將盡最大努力採取適當的技術手段,保障您可以訪問、更新和更正自己的註冊資訊或使用 TalkingData 服務時提供的其他個人資訊。

 

1 、訪問您的個人資訊

你可以通過登錄帳號,進入 帳戶管理 頁面自行訪問您的個人資訊,法律法規規定的例外情況除外。

 

2 、更正或補充您的個人資訊

當您發現我們處理收集的關於您的個人資訊有錯誤時,或者您的個人資訊需要更新補充時,您可以通過登錄帳號,進入 帳戶管理 頁面,自行更正或補充。

某些特殊資訊的更正可能無法自行操作,您可以根據或通過本隱私政策或 TalkingData 網站上公佈的多種聯繫方式與我們聯繫。為保障您的帳戶安全,我們可能會要求您進行身份驗證。

 

3 、刪除您的個人資訊

您可以通過註銷帳號,在 TalkingData 網站進行 OPT-OUT 隱私設置以取消您授權我們收集和使用您的個人資訊,我們將停止使用並刪除您的個人資訊。請注意,我們可能不會立即從備份系統中刪除相應的資訊,但會在備份更新時刪除這些資訊。

在下列情形中,您可以向 TalkingData 提出刪除您的個人資訊的請求 :

1   我們處理個人資訊的行為違反法律法規或與您的約定的;

2   我們對您的個人資訊的收集和使用,未能獲得您明確同意的;

3   我們終止向您提供或您主動終止使用 TalkingData 的產品或服務的。

若我們決定響應您的刪除請求,我們還將同時盡可能通知我們分享獲得您的個人資訊的協力廠商,要求該等協力廠商及時刪除您的個人資訊,除非法律法規另有規定,或該等協力廠商已獲得您的獨立授權。

 

如果您無法通過上述路徑訪問、更新或刪除該等個人資訊,您可以隨時通過 TalkingData 客服與我們取得聯繫。我們將在 15 天內回復您的訪問請求。

 

儘管有上述規定,為解決爭議、執行使用者協議、遵守與安全運營相關的技術要求,在法律允許的範圍內,我們仍可能保留某些資料到合理的時間。

 

四、個人資訊保護措施

 

1 、我們採取的資料保密的措施

 

在互聯網上沒有任何傳輸方法,或電子存儲方法是百分之百安全的,儘管我們已經盡到合理努力,但仍有可能被盜、非法擁有或者濫用而給您和您的用戶帶來人身、財產和聲譽等方面損失的危險。您已瞭解上述風險並自願承擔。

 

我們將採用行業內通行的、合理的標準來保護我們所儲存的資訊的安全性和保密性。包括但不限於:防火牆和資料備份措施;資料中心的存取權限限制;對移動終端的識別性資訊進行加密處理等。

 

我們已經建立健全資料安全管理體系,包括對使用者資訊進行分級分類、加密保存、資料存取權限劃分,指定內部資料管理制度和操作規程,從資料的獲取、使用、銷毀都有嚴格的流程要求,避免使用者隱私資料被非法使用。

 

我們還建立了定期舉辦安全和隱私保護培訓的培訓機制,提高員工的個人資訊保護意識。我們將不定期的審查、更新並公開 TalkingData 安全風險及個人資訊安全影響評估報告。

 

2 、應急處置與預警

若不幸發生個人資訊安全事件的,我們將按照法律法規要求,及時通過站內信 / 您預留的聯繫方式等向您告知安全事件的基本情況和可能的影響、我們已採取或將採取的應急回應及其他有關處置措施、對您的補救措施等。若難以逐一告知個人資訊主體時,我們將採取合理、有效的方式發佈公告並將主動向有關監管部門上報個人資訊安全事件的處置情況。

 

若您發現您的個人資訊洩漏時,請您立即通過本聲明約定的聯繫方式與我們聯繫,以便我們及時採取相應的措施。

 

五、我們對未成年人資訊保護

 

我們已經在服務前提中明確,不接受未成年人註冊登記成為我們的用戶。在知情的情況下,我們不會收集和使用未成年人的資料。

 

如果您的應用是針對未成年人而設計和開發的,請務必確保您的終端使用者的註冊和使用應用是由未成年人的監護人進行的。

 

六、我們如何向其他方披露和共用資訊

 

除非本政策已說明的情況外,您的資料不會被以可識別的形式向協力廠商披露和共用。但以下情況除外:

 

1 、獲得您的事先同意;

 

2 、因司法、行政等合法程式的要求;

 

3 、在有限的情況下,我們有可能聘請協力廠商供應商、顧問或其他服務商為我們提供必要的維護、支援和服務,唯該等協力廠商因履行我們的工作必要,且已與我們簽署必要的條款保護資料安全和保密性的。

 

4 、在緊急情況下,經合理判斷是為了保護我們、我們的代理人、客戶、終端使用者或其他人的合法權益和安全的。

 

5 、我們為維護自己或其他用戶的合法權益而向用戶提起訴訟或者仲裁的;

 

6 、我們正在或擬進行企業並購、重組、出售全部或部分股份和 / 或資產等重大變化,包括但不限於盡職調查過程。

 

基於經授權合法收集的個人資訊,通過資訊系統、演算法等非人工自動決策技術實現標籤化或畫像處理,從而做出的自動決策決定(如商業化資訊推送),此行為構成資料的不可識別化,並未向任何協力廠商共用、轉讓或披露您的任何個人資訊。如果您不希望參與此類定向廣告資訊推送,請通過 OPT-OUT 管道 ( http://www.talkingdata.com/optout.jsp?languagetype=zh_cn) 取消。

 

七、國際轉移問題

 

在提供服務的過程中,我們可能將從您或您的產品終端使用者那裡收集到的資料轉移到您所在的司法管轄區域之外的我們的關聯實體或其他協力廠商,該等轉移將在法律法規的許可範圍內,並根據本政策對您的個人資訊進行處理和提供足夠的保護。如果您或者您的產品終端使用者位於中華人民共和國司法管轄區域之外,或者當您或您的產品終端使用者位於中華人民共和國司法管轄區域內,但我們有需要轉移到中華人民共和國司法管轄區域之外時,您應同意或者取得終端使用者的同意有關此項國際間轉移。

 

我們強烈建議您諮詢當地專業人士,以保證此項轉入或轉出符合當地資料保護的要求。特別是,當國際轉移涉及到歐盟地區或者美國地區時,請注意這些國家和地區的個人資訊資料保護的合法性規定。

本政策是 TalkingData 服務條款的重要組成部分。

 

九、適用法律與爭議解決

 

本政策應根據中華人民共和國法律解釋與管轄,有關與您和 TalkingData 之間發生的任何形式的爭議均應友好協商解決。協商不成的,任一方均有權將爭議提交北京仲裁委員會根據其屆時有效的仲裁規則在北京申請仲裁裁決。

如果您對我們的回復不滿意,特別是認為我們的個人資訊處理行為損害了您的合法權益,您還可以向網信、電信、公安及工商等監管部門進行投訴或舉報,或者根據第九條進行爭議解決。

 

User Agreement

 

Please carefully read the following regulations before registering an account of this game for the purpose of protecting the rights and interests of Party A in using the services of online game (hereinafter referred to as the Game) that is licensed by Party B. Besides, for the sake of rights and interests of Party A, please review the Agreement regularly due to its possible change.  

 

Article 1

Party A understands that the agreement to this Agreement indicates his acknowledgement that he(or she) has carefully read and understood this Agreement for more than three days and shall be willing to accept this User Agreement and rules concerning the game and agree to be bound by its terms.

 

Article 2

Party A understands that his agreement to this Agreement indicates his acknowledgement that he (or she) understands and complies with all terms in the Agreement.  

Please note that if Party A has no disposing capacity (such as juveniles under seven), his (her) legal agent shall be in charge of the application for game service; if Party A has limited disposing capacity (between seven and twenty), he (or she) shall get the permission of legal agent before application.

 

Article 3

For the sake of sound development of children and juveniles and protection of their rights and interests, Party A shall understand that the Protection Rating of this Game is based on the standards of Game Software Rating Regulations. Once Party A presses the button of [Agree], it indicates that Party A has met the requirements on age of using this rating services under relevant laws and decrees.  

 

Article 4  

For the purpose of fully enjoying the game, Party A agrees to that Party B does not provide any consumption services temporarily within seven days from playing the game, including but not limited to, purchasing any virtual objects, functional props or decoration props.  

 

Article 5 Limitation of Agreement

Party B provides Party A with the services of online services and other relevant services (hereinafter referred to as Services). The rights and obligations of both Parties concerning the Services shall be subject to the Agreement.

 

Article 6 Items in Agreement:

The following items shall be deemed as part of the Agreement and have equivalent effect to the Agreement.                    

1.The advertisements or publication contents concerning the Services of Party B.

2.Triff and Rules of Game Management  

In the event of conflicts arising in previous contents of the Agreement, the interpretation shall be in favor of consumers.

 

Article 7 Definition of terms

The terms under the Agreement shall be defined as below:  

1.Online Game: refers to the software that enables Party A to simultaneously connect with most other players through Internet with network server erected by Party B.

2.Game Websites: refers to websites built by Party B to serve the game.

3.Rules of Game Management: refers to the rules compiled by Party B for normalizing ways of playing the game and rules of members’ behavior.

4.Game Process:refers to the electromagnetic records provided by the computer of Party B while Party A is playing the game.

5.Recharge: refers to the amount of money that Party A prepaid to Party B or the balance of Party A.

6.Memory Manipulation Program: refers to a program that is not provided by Party B to influence or change the operation, service and ways of playing of online game  

7.Start Game: refers to the time when Party A applies for the service account of online game provided by Party B.

8.Game Package: refers to the software equipped with main program and subprogram so as to completely support all functions of online game.

9.Download: refers to the behavior of downloading game package through network.

10.Necessary Costs: refers to the costs disbursed or paid to the Third Party by Party B for the purpose of performing the Agreement.

 

Article 8 Scope of Service

In accordance with the Agreement, Party B provides Party A with the service of server to log in the game through Internet, excluding the service applying to service provider for access to Internet and all hard equipment for surfing the Internet.

 

Article 9 Game Log-in

Upon application for registering the game, Party A shall use the individual information that is consistent with his ID to log in. In case of error or change of individual information, Party A shall revise it immediately.  

If Party A fails to provide true individual information or the previous individual information is inconsistent with latest true information, Party B shall cease the service temporarily (including but not limited to ceasing playing game and reviewing the process of game) before Party A provides true information or updates information, excluding that Party A can provide proof of being the party to the Agreement through other materials other than individual information.

Party A may terminate the Agreement with email or written form notice to Party B within seven days from the day of starting the game without necessity of any explanations or bearing expenses. After terminating Agreement, Party A may require Party B refunding based on balance. Regarding to this termination, Party A shall undertake relevant obligations of deleting all information: including but limited to deleting character, account and virtual objects.

 

Article 10 Charging Standards

In the event of tarrif changes, Party B shall make an announcement in websites, games and log-in interface thirty days prior to the effective date of changes. If Party A has logged in email upon registering an account, Party B shall notify Party A in email.

In the event of tarrif changes, recharge shall be in accordance with new tarrif since the day that adjusted tarrif comes into force; if new tarrif is higher than previous tarrif, the recharge of Party A prior to the effective day of new tarrif shall also be in accordance with previous tarrif.

After Party B gives notice to Party A in the light of the address, the arrival of written notice at the address or arrival of email at the server of Party A indicates that the notice has been sent.

 

Article 11 Game Specification

Party B shall specify the following items on game websites and game package:

1.The rating of game and the age that is not allowed or allowed to play the game based on the Game Software Rating Regulations。

2.Requirements  

Requirements on software and hardware that support operation of the game.

1.Refund rights stated in Item One of Article .

2.Free information or charge information in case of security device service.

The security device provided by Party B at present is digital security card (free)\ OTP (free)、smart lock(free)、mobile phone lock (free).

 

Article 12   Refund of Game Package and Software.

Party A may require full refund from the original seller within seven days after purchasing the package or paying for downloading relevant software. Regarding to the above issue, in case that the Seller does not handle it or is incapable of handling it, Party B shall refund immediately as required by Party A.

 

Article 13 Validity of Agreement

Upon initial registering an account, in case that Party A clicks [Agree] on the website of the Agreement after review, it is deemed as a consent with the regulations on the Agreement.

In the event of invalidity of any parts in the Agreement, the validity of other parts in the Agreement shall not be influenced.

 

Article 14 Use of Account and Password

After Party A completes registration, Party B shall send the account and password to Party A. No altering is allowed once the account is set. The username and password shall be used for Party A only. Party A shall not transfer or lend it to the Third Party. Otherwise, Party A shall be solely responsible in the event of conflicts arising from that.

The change of above password shall be in accordance with the mechanism provided by Party B. No one of Party B (including customer service staff, game administrator) will initiatively ask Party A for password. Party A shall be entirely responsible for security of the account and password and shall be solely responsible in case that account and password are illegally used by others due to careless care.

 

Article 15 Notice and Disposal for Illegally Use of Account and Password

Either Party A or Party B shall inform the other immediately as soon as they find that The Third Party illegally use the account or abnormally damage security of the account of Party A. After receiving the notice from or informing Party A about the issue above, Party B shall temporarily cease access of the account or password and replace it with new account or password in case that it is confirmed by Party A.

For the issue mentioned above, Party B shall refund the deducted charge or give compensations equivalent to game costs with the exception of liability for Party A.

 

Article 16 Disposal for Improper Transfer of Electromagnetic Record

In case of finding illegal use of account and password and improper transfer of electromagnetic record, Party A shall inform Party B of verifying. After verifying the ID of Party A, Party B shall immediately ban the account and temporarily control the rights of relevant online game user.

In case of knowing the process of electromagnetic records or ID information of the third party with electromagnetic records, Party B shall make inform the third party of clarification in written or email since the rights of playing game have been controlled. If the third party fails to clarify it within seven days after receiving the notice, Party B shall directly reply Party A to improper transfer of electromagnetic records. Upon failed reply, it is handled with equivalent compensation adgreed by both Parties; after reply, freezed rights of relevant user are unfreezed. Only when Party B provides free security device (such as anti-theft card, mobile phone lock) which is used by Party A, then Party B can directly reply to Party A that electromagnetic records are improperly transfered.

In case that the third party with such electromagnetic records does not consent with the above disposal, Party B may follow the judicial way based on procedure of reporting a case. During controlling the rights of Party A to play the game based on item one, Party B shall not charge Party A any fee.

Should the rights of Party B or other online game players are persecuted due to false declaration from Party A, Party A shall be entirely responsible.  

 

Article 17 Save and Inquiry of Game Process

Party B shall save individual game process for two months for inquiry of Party B. In case of overdue electromagnetic records, Party B cannot handle the application for inquiry of Party A.

Party A may apply for checking individual game process in written form or network or in service center of Party B with true ID documents for examination at own costs of RMB 50 per account.  

After getting the inquiry application of Party A, Party B shall provide data of the game process listed in item one in storage medium (optical disk or disk) or written form and email.

 

Article 18 Individual Information

Individual information shall be protected based on relevant laws and decrees.

Party B shall not sell, exchange, lease or expose the name, address, email and other individual information without permission from Party A unless it is required by laws or relevant authorities.

Within the authorization under the laws and decrees, Party B may use the individual information of Party A for providing other services as required by the Agreement, including but not limited to the email.

Party A agrees Party B to incorporate his (or her) individual information into members’ statistical data, and agrees Party B to publically use the statistical data under laws provided that it does not involve disclosing ID of Party A.

In the event of following cases, Party B may publically disclose the information or game process of Party A under the law:

1.As required by relevant authorities.

2.For the purpose of protecting properties, rights and interests of Party B.

3.For the purpose of protecting security of members of Party B or the public under emergencies.

4.As required by the third party to whom Party A is related for review relevant game process.

 

Article 19 Electromagnetic Records

Party B shall have the ownership of all electromagnetic records of the game and shall keep the records the Party A complete. Party A shall have the right to dominate the records hereinabove.

 

Article 20 Information Disclosure

Party B shall disclose and regularly update relevant information of games in websites.

 

Article 21 Quality of Connection

Party B shall make announcements on websites seven days before shut-down for maintenance of system as prearranged and notify shut-down message during gaming.

Party B shall insure that no error, scene suspension, lag, breaking off or failed connection arises in the system equipment. In the event of failing to provide services for Party A due to hereinabove reasons, Party B shall refund the deducted charge, or exempt the equivalent charge or extend the time of gaming for Party A.

 

Article 22 System Safety

Party B shall be responsible for maintaining the computer system to guarantee its technically or professionally consistency with the sound expected safety during providing services under the regulations of the Agreement.

Provided that computer system or electromagnetic records are damaged or computer system operates abnormally, Party B shall reply as soon as possible after taking reasonable action.

If Party B violates the two regulations hereinabove and thereby incurs damage to Party A, then Party B shall be responsible for compensating the loss of Party A based on the damage. But if Party B can prove the absence of fault, the liability of compensation may be relieved.

If computer system of Party B fails operating as described above, Party B shall not charge Party A before normal operation.

If electromagnetic records cannot be saved or similar problems caused by overloading of server of Party B due to liability of the Party B, Party B shall restart the server to restore the status of game prior to overloading.  

The products or services (including but not limited to virtual prop) that Party A agrees to buy may not be used with original set due to set of system or program or other factors. If the damage to rights and interests thereby caused is attributed to Party A, Party A agrees that Party B shall not compensate or partially compensate the damage or loss. If it is attributed to Party B, Party A consent with that Party B compensates in common way. All the products or services provided by Party B, including but not limited to virtual equipment, electromagnetic records and so on, shall be possessed by Party B or relevant subjects of the rights. Party A understands and agrees to use the products or services in normal way based on the set of game until they die out naturally or the services terminate. Upon the expiration of the agreement duration or meeting conditions, Party A agrees that Party B shall not provide any follow-up processing, including but not limited to, extending the deadline and compensation of the products or services (including but not limited to virtual equipment) or other similar products or services.  

 

Article 23 Program Bug

If the loss to Party A is attributed to program bug of Party B, Party B shall be responsible for compensation based on the degree of loss. However, the liability of Party B may be relieved in case of proving the absence of fault.

 

Article 24 Game management  

To normalize the rules of playing games, Party B shall devise reasonable and fair rules for game management. Party A shall observe the rules of game management, relevant laws and regulations in China and all other regulations and common practices of international network and shall assume the legal liability of all contents delivered with the service.

1.Regulations on Violation of the Agreement

In case of any one of the contents as below, it is deemed as violating the rules:

Publish, spread or transmit any defamatory, obscene, indecent or unlawful remarks or message that infringe the rights, interests, property of game company, game agents and others in official fan team and other public places.

The change of game management rules shall be in accordance with Article 27.

2.Deprive and limit the rights of Party A under agreement

Party B which handles it in accordance with Article 25 shall be exempted from the requirement.

To further manage and maintain the quality of games, Party A agrees that Party B sends email to him(or her) and the system saves the records of violating the Agreement or management rules automatically when Party A plays game with plug-in, virus program, game program bug or other unfair way. The above mentioned records include following data: CPU types, operation system types and versions, computer name and ID, access path improper program.

 

Article 25 Disposal for rules violation

Unless otherwise provided in this Agreement, if there is evidence showing that Party A violates rules during game, Party B shall make an announcement in game websites or ongoing game and inform Party A to improve through real-time communication or email. Where the party fails to improve or violate again after being notified to make improvement, Party B shall limit his (or her) rights of playing the game based on the degree of violation in accordance with the rules of game management. Based on rules of game management, Party B shall cease the rights of Party A to play game for seven days at most. If the party violates again after warning, Party B shall terminate the Agreement.

Apart from the case where it becomes grounds for terminating the Agreement, Party B shall not dispose Party A based on rules of game management in a way that influences the rights of Party A under the Agreement.

 

Article 26 Rights of Appeal

Provided that Party A dissatisfies the connection quality, game management, charging and other services or the rules of game management, Party A may ask Party B for an appeal in email or written form within seven days since the next day of receiving the notice. After receiving the appeal, Party B shall reply the disposal within fifteen days.  

Party B shall provide the 24h service hotline and email address in game websites or rules of game management.

 

Article 27 Change of Agreement

During changing the Agreement, Party B shall make an announcement in game website homepage or login interface. If Party A clicks [Agree] and continue to play the game, it indicates that Party A agrees to the change of agreement. If Party A opposes it, it shall be deemed as a notice of terminating the Agreement.  

Party A shall guarantee the address or email provided to Party B is correct and shall inform Party B immediately in case of change.  

After Party B gives notice to Party A in the light of the address, the arrival of written notice at the address or arrival of email at the email server of Party A indicates that the notice has been served.

 

Article 28 Termination and Refund of Agreement  

Party A may inform Party B of terminating the Agreement in case of any cases as below:  

1. The server fault of Party B causes that the game fails to run for more than 48h.  

2. Party B gives no reply within thirty days after receiving the appeal from Party A.

Upon terminating the Agreement, Party B shall refund the used charge or fee of Party A in cash, credit card, bills or cheque with registered mail within thirty days after deducting the 30% charge as necessary costs.

In case of any following events, Party B shall terminate parts of or the whole Agreement after informing Party A in written or email or advertisement.

1.Use any system or tool to maliciously attack or destroy the computer system of Party B.

2.Play game by using plug-in, virus program, program bug, posting remarks of account deal or in other unfair way which violate the statement in Article 4.

3.Illegal behavior is found after investigation of judicial institution.

Provided that Party B falsely identify the above facts or cannot provide evidence, Party B shall be responsible for compensating the loss incurred by termination of Agreement.

 

Article 29 Serve  

Party A agrees that Party B deliver all notice concerning the Agreement to the linking address or email that is used for log-in.

After Party B gives notice to Party A in the light of the address, the arrival of written notice at the address or arrival of email at the email server of Party A indicates that the notice has been served.

Provided that the notice cannot be successfully served to Party A due to that the individual information is false or cannot be updated, Party B shall not be responsible for compensating the loss incurred thereby.

 

Article 30 Lex Causae

Law of the People's Republic shall be the lex causae governing the Agreement.

 

Article 31 Competent Court

In the event of any disputes arising out of the Agreement, both parties agree that the Taipei District Court shall be the competent court with jurisdiction in the first instance. However, this does not exclude the application of Article 47 of the Consumer Protection Act or Article 436-9 of Civil Procedure Code for the small-claim proceeding. Article 3 2 Use TalkingData

Beijing Tendcloud Tianxia Technology Co.,Ltd and its affiliates (hereinafter referred to as “we/us” or “TalkingData” collectively), as a company focusing on internet comprehensive data service, pays much attention to protection of personal information and privacy in data service all the time. When you visit TalkingData website or sign up for any product and service of TalkingData, we will comply with the legal and regulatory requirements and take appropriate security measures as much as possible to protect your personal information safe and controllable.

3、 Details for Usage of TalkingData Services

1) TalkingData Analysis Service

TalkingData provides data statistics analysis service for mobile application through your integration of TalkingData data SDK and API in application. Your application will collect and transfer relevant data of your terminal users through technical means, and our service will help analyze these data to learn the performance and user’s usage situation of your application on different terminal equipment, platform or application distribution channel.

Your terminal users’ data usually include but not limited to, SDK or API version, platform, time stamp, application mark, application version, application distribution channel, iOS IDFV, iOS IDFA, Android advertiser mark, equipment model, terminal manufacturer, terminal equipment OS version, conversion start/end time, language residence, mobile network/country code, time zone and network situation (WiFi and so on), hardware, CPU and battery usage situation and so on.

In accordance with your mobile application type and your requirement on statistical analysis, your terminal users’ data may also include: user’s gender, age, location, equipment information, OS, operator, promotion channel, trigger event, mistake report and volume of page view and so on.

For the purpose of analysis service, TalkingData analysis service will send above data to TalkingData server through your application, and display in convergent data and analysis report. You could check relevant statistics and analysis result through logging in account on our website.

2) Industry Report Service

We will build TalkingData database based on data collected by analysis service and by other legal means, and make analysis report about application’s performance evaluation or behavior pattern (hereinafter referred to as “industry report”) in publisher, industry, certain area and market. Industry report will be displayed in unidentified convergent way, including those published by TalkingData itself and those customized in accordance with your requirement.

Under special situation, we also make evaluation result about application of certain type or kind in accordance with TalkingData’s statistic model. Such evaluation result may present certain coincidence with your application because of data acquired from your application, however, these evaluation result are made based on our statistic model for the purpose of evaluation which is convergent and anonymous.

3) TalkingData DMP

We will build TalkingData database based on data collected by analysis service and by other legal means, and form TalkingData’s TDID through converging, washing, calculating,and so as to build huge third party group data center. Such center will divide mobile terminal users into different groups by character and hobby, and provide group mark information for all practitioners by open interface, in order to optimize launch and improve marketing effect.

Users could match TDID through TalkingData DMP and buy the corresponding mark information. These mark information are obtained through collecting large amount of mobile application users’ data, anonymization and intelligent operation, and ultimately displayed in statistical analysis data, contains no personal privacy or identifiable data.

4) Commercial Cooperation with the Third Party

Besides the service we provide in the form of TalkingData DMP, we also cooperate with a third party in various ways to utilize the data collected processed and handled through TalkingData DMP, which include but not limited to cooperate with advertiser, advertising alliance or advertise agency to optimize advertisement launch and improve marketing effect. Such data we shared with the third party contains no personal privacy or identifiable features.

5) Smart Data Market

We are providing service named Smart Data Market for both data service provider and data demander and such Smart Data Market aims to facilitate the online transaction of data as well as its derivatives (referred to as Data Products, no matter in form of data API, tools or Application software) which are produced and/or processed by TalkingData itself or authorized to deal by the third lawful rights owner.

It is guaranteed that Data Products produced and/or processed by TalkingData itself are clear of ownership and in compliance with relevant laws and regulations about personal information protection. In general, the Data Products which are transacted or authorized in Smart Data Market are de-identification ones. Under some special circumstances when personal information data may be accessed, it is required that explicit authorization be received from related person and the using of such data be limited within the specific range. Meanwhile, we are trying our best with reasonable discretion to require the third data owner to guarantee its Data Products meet the requirements above.

6) Consulting

We provide Solution, PSO and Big Data Lecture.

When providing these services, we may ask you to provide more personal information to understand your business or product situation, please decide cautiously whether to provide according to your demands.

4、Exception

Pursuant to relevant laws and regulations, it is not necessary to obtain your authorization to collect your personal information in the following cases:

1) Related to national security and national defense safety;

2) Related to public safety, public health and major public interest;

3) Related to criminal investigation, prosecution, trial and enforcement of judgments;

4) To avoid legal emergency and fail to obtain your consent in time;

5) For purpose of academic research and related outcomes have been de-identification;

6) The information we collect is from which is made public by yourself;

7) The information we collect is from which is publicly and legally disclosed;

8) To fulfill the contract you have signed;

II. Authorization and Consent from End Users’ Data

You are clearly aware of that, you need us to collect, store and process personal information from terminal user of your application, for the purpose of our data statistics and analysis. Therefore, you must undertake:

1)You have obtained fully necessary authorization, consent and permit from terminal users, for the purpose of our performance of service;

2)You have obtained fully necessary authorization, consent and permit from terminal users for us in order to anonymously and convergently process, transfer (including possible international transfer) the data we collected;

3)You have complied and will comply with applicable laws, regulations and supervisory requirement, including but not limited to formulate and publish policy relevant to personal information protection and privacy protection.

4) You should make the disclosure and explanation to the end user, allowing us to transfer our collected data to the third parties for Internet targeted advertising purposes on the condition that anonymous and polymerization processing have been made wit h respect of such data information before transfer. You should also provide end users with easy-to-operate selection mechanism, indicating how and when the user may exercise the option and how and when the user can modify and withdraw such option, so that the user can choose to agree or disagree with the collection and use of his/her information and transfer of such information to the third parties for Internet targeted advertising purposes.

You shall be liable for the comprehensive settlement and compensation to us for our possible loss in any kind, if you violate the commitment above and thus causing your terminal user’s claim or right request against us in any kind, or causing us to be involved in legal or administrative procedure.

 

III. How to Manage Your Personal Information

We will try our best to take appropriate technical measures to safeguard your access, updating and correction of your registration information or any other personal information you provided when using TalkingData Service.

1、Access

You can access your personal information by going to the "Account Management" page and logging in to your account, except as provided by laws and regulations.

2、Correct and/or Supplement

When you find there is any mistake about your personal information we collect or there should be update about your personal information, you can log in the "Account Management" page and correct or update by yourself.

IF there is certain special information may not be processed by yourself, you shall contact us through various contacts posted either on this privacy policy or on other TalkingData webpages. To protect your account, we may ask you to finish verification.

3、Delete

Your choice to close your account or click the OPT-OUT on the TalkingData website would be deemedthat you choose to withdraw your authorization. We would stop collecting your personal information and delete your personal information. Please understand that we may not delete your personal information immediately from the backup system, but will delete your personal information when the backup is updated.

You can request TalkingData to delete your personal information in following cases:

1) We deal with your personal information in a way which violate laws, regulations or agreement with you;

2) We collect and use your personal information without your explicit consent;

3) We and/or You terminate the services between You and TalkingData.

If we decide to respond to your request for deletion, we will also, as soon as possible, notify the third party which we have share your information to delete your personal information, unless this kind of party has acquired your authorization, or other contrary provisions in law.

 

If you are unable to access, update or delete your personal information through the above path, you may contact us through TalkingData Customer Service at any time. We will respond to your request within 15 days.

 

Notwithstanding the above provisions, we may keep certain data for reasonable term within the limit allowed by law for dispute settlement, users’ agreement performance and compliance with technical requirements related to safe operation.

 

IV. Personal Information Protection Measures

1、Security Measures for Data

No transfer means or digital storage means on the internet is 100% safe. Although we have made reasonable efforts, there are still risks of loss to your’s and your user’s person, property and reputation caused by theft, illegal possession or abuse. You have learnt the risks above and would like to undertake them.

We will comply with general and reasonable standard of industry to protect the safety and confidentiality of information we have stored. Including but not limited to: firewall and data backup measure; limited access to data center; confidential agreement with employee and security management system; hash processing to identification information of mobile terminal.

We have set up the data security management system and improved continuously, including the classification of user information, encryption and preservation, data access rights division, the designated internal data management system and operating procedures. We have strict process in data acquisition, use and destruction to avoid your personal information is illegally used.

 

We have also established a training mechanism that regularly organizes safety and privacy protection training to raise awareness of employees' personal information protection. We also periodically review, update and disclose the TalkingData Security Risk and Personal Information Security Impact Assessment Report.

 

2、Emergency and Early-warning

If there is security incidents going on, we will promptly inform you that the basic situation and possible impact of the security incidents, the emergency response that we have taken or will take, other related measures for disposal and remedial measures for you through the station letter / your reserved contact information in accordance with relevant laws and regulations. If it is difficult to inform everyone, we will take reasonable and effective way to issue announcements and we will voluntarily report the security incidents as well as the disposal to relevant regulatory authorities.

 

If you find any leakage in your personal information, please immediately contact us and we would take appropriate measures in time.

 

V. Protection for Juveniles Information

We have mentioned in precondition of the services that we refuse to have juveniles registered as our users. We will not collect and use juveniles’ data if we knew.

If your application is designed and developed for juveniles, please ensure that the terminal user’s registration and usage of application is conducted by guardian of juveniles.

 

VI. How We Disclose and Share Information

Except for the situation provided hereof, your data will not be disclosed and shared to third party in an identifiable way. However, situations below are exceptions:

1、Having Obtained your prior consent;

2、Required by judicial, administrative or other legal procedure;

3、 In the limited circumstances, we may engage the third party provider, consultant or other service provider to provide the work for us with the necessary maintenance, who has executed necessary terms with us to protect safety and confidentiality of dat a.

4、In case of emergency, to protect the safety and legal rights and interests of us, our agents, clients, terminal users or others, after reasonable judgment.

5、We file a sue or arbitration to defend the rights and interests of ourselves or other users.

6、We are conducting or contemplate to conduct material changes such as mergers and acquisitions, reconstruction, sale of all or part of the share and/or asset, including but not limited to due diligence process.

Based on the personal information that is legally collected, automatic decision-making (such as commercial information push) is implemented through tagging or profile processing through non-manual automatic decision-making techniques such as information systems and algorithms. If you or your product terminal user is located beyond jurisdiction of PRC, or when you and your product terminal user is in jurisdiction of PRC while we need to transfer it to the place outside of jurisdiction of PRC, you shall consent or obtain consent from terminal user for this international transfer.

We highly advise you to consult local professionals to ensure this transfer complying with local data-protection requirement. Especially, when the international transfer involves EU and USA area, please pay attention to the legal regulation for personal information data protection of these countries and areas.
